Colloquium on the History of Criminal Procedure and Conspiracy

In the colloquium, guests and researcher will present papers from their current research projects dealing with the history of criminal procedure and conspiracy. Clara Borges, for instance, focuses on the Brazilian Code of Criminal Procedure of 1941 and analyses how the Brazilian criminal processualists compared this code with Italian fascist legislation in order to come up with an effective form of critique as well as develop proposals for reform. Victor Saucedo will discuss a new approach to the appearance of common law as a cognitive system and legal change as a form of semantic drift by focussing on the cognitive processes by which legal concepts – such as conspiracy – emerge, expand, blend, and are structured. Raquel Sirotti, Alexandra Woods, and Karl Härter will comment on the presentations and draw some comparisons with the Institute’s research on the history of political crime, penal law and criminal procedure.
