Jan Schröder: Gibt es zeitlose Theorien in der Rechtswissenschaft? (<em>Are there timeless theories in jurisprudence?</em>)

Are there any timeless theories in legal science?

While the scientific character of jurisprudence has been the subject of discussion for hundreds of years, there is virtually no substantial position regarding whether it has developed timeless theories. In light of the historicity of the humanities and social sciences, i.e. their dependence on the changing political, cultural, social, etc. influences, it would seem unlikely that legal science has brought forth a substantial number of supra-temporal or timeless theories. Drawing on examples from the history of the juridical methodology and the dogmatics of private law, this lecture pursues the question as to which juridical theory are more enduring –above all, whether we can distinguish between dogmatic and non-dogmatic theories – and under what conditions or circumstances does a juridical formation of theory have prospects for persisting.
