The liberation of the individual at the turn of the 19th century entailed great transformations in all areas of social life. The newly won freedom had to be organised legally. This was especially true of labour activities, which remained dominated by occupationally based social strata. A legal system emerged that was built on coequal principles rather than separate, parallel orders.  Equal freedom in law became a basic principle. Labour law had always regulated social problems as well, so examining the transition to a principle requires a ‘social’ approach as well.

This study treats the development of the new principles of private law by investigating the legal reflex at the level of servants as an especially precarious element of labour. Specifically, it examines servants’ rights to have principles implemented and breached, following the approach in legal history that takes the history of servants as ‘an example of the most important economic and social lines of development in the 19th century’ (Toni Pierenkemper). The evolutionary development of Prussia serves as a paradigmatic case study, which is refined through comparisons with other orders, like the revolutionary transformations in Frankfurt. Servants, as an institution, were not only an anachronism in the 19th century; they also represented the dynamic developments and problems of private law in that period. This case exemplifies the laborious transformation of a premodern occupational status with especially strong attachments to private law. The comparison with commercial labour law reveals many parallels, especially in terms of interventions in public law as well as in the household and family.
