Stefan Vogenauer Presents New Publication at the 2018 Conference of the German Bar Association

On 8 June 2018, Professor Stefan Vogenauer presented his most recent book at the annual conference of the German Bar Association in Mannheim. The German Lawyers’ Day (Deutscher Anwaltstag) has been the national conference of the German Bar Association (Deutscher Anwaltverein) since 1949. Practitioners, judges, politicians, academics and journalists meet to discuss issues of legal policy and professional conduct. At the same time it is one of the world’s biggest fora for lawyers’ continuing professional development.

Together with his co-author, Dr Volker Triebel, Professor Vogenauer outlined the major findings of their book on Englisch als Vertragssprache (‘English as the language of the contract’). It deals with an increasingly frequent issue arising in cross-border commercial contracts: the parties draft their contract in the English language but the agreement is governed by the law of a non-English speaking jurisdiction. As a consequence, the rules of, say, German contract law apply to clauses which were first drafted against the background of English or American law. The book explores the tensions arising from the divergence between the contractual language and the governing law and suggests strategies for resolving them. It is a fruit of the Institute’s Research Focus Area ‘Translation’.
