Guest lecture - <em>On the divisio obligationum </em>in <em>res cottidianae</em>

The categorisation of the reasons for incipient obligations (divisio obligationum) in res cottidianae deviates from the external typology of Gaius’s Institutes, yet the structure of the classical real obligations (obligatio re contracta) remains unchanged. In the Institutes, the expression re contrahitur obligatio is restricted to credit. That the explanations of loans, deposits and pawning appear directly after the discussion of credit in res cottidianae (D. 44,7,1,2-6) does not, however, mean that these debt relations also represent obligationes re contractae. A careful analysis of the sources reveals that neither loans, deposits nor pawns are ‘real contracts’.
