The thesis Fritz Kern posited a good 100 years ago regarding the nature of the medieval understanding of law, shortly after its publication, managed to captivate the constitutional and legal-historical historiographers. A considerable number of Germanic-legal historical as well as medievalist constitutional-historical academic traditions in the 20th century can be brought into connection with the well-known teachings of the good old law. This is above all the case within the German-speaking realm. However, even beyond the ranks of these traditions, Kern’s teachings had found fertile ground; and in addition to the discipline-related historiographies, there are those who were still tempted to draw upon his illustrative thought process. This study attempts neither to affirm or nor refute Kern’s approach, but rather for the first time makes him the subject of a historiographic investigation: How and why did the Kernian concept arise, and which function did it fulfill? This volume is aimed at legal and constitutional historians as well as medievalists and historians of science.
